Terms and Conditions

Pop-in™ sessions are subject to the following terms and conditions. By booking a Pop-in appointment you confirm that you have read, understood, and agree to these terms and conditions and our privacy policy.

What does it cost?

Monthly Pop-ins are quick sessions for one child only at a local photographer's studio or other advised location. The price per Pop-in is $25NZD and must be paid online via credit card through Stripe. This price is subject to change without notification. Special events are available throughout the year at prices as quoted while booking. Prices are non-negotiable.

What do we get?

You will receive a single digital photo of your child in the Pop-in chair and this image is made available to you within your online Little Annie account. This unique digital file is made available within a reasonable time period (normally no more than seven days following your Pop-in pending any technical difficulties outside of our control), you will be notified via email when your photo is ready to download. You acknowledge that there are no extra images to choose from, and there is no option to choose another image if you are dissatisfied with the one you have been given. Using the online feedback module you may opt to request photo retouching or an additional image taken at your shoot, there is a $25 service fee for these requests which is charged if your photographer can successfully provide a remedy based on your instructions. On occasion the photographer may opt to provide this service without charging, this is at their sole discretion.

Sibling and family sessions may be available at some Pop-in locations for additional fees throughout the year and will be advertised through the Popaholics Facebook group and to the promotional email list. For more information on sibling or family sessions please contact your photographer.

Please note that all Pop-in events are on a specific day/s between set hours, each month in each location and you can come as often or as infrequently as you like based on this availablity. Little Annie shall use its reasonable endeavours to ensure that these monthly sessions will be held every month, however the permanent continuity of the project cannot be guaranteed. Little Annie reserves the right to discontinue the monthly Pop-in sessions, change local photographers, and change locations at any time without warning.

You agree that your information can be provided to the local photographer running the Pop-in™ sessions, in accordance with Little Annie's privacy policy.

 

What if we are sick?

If you or your child is sick, please be compassionate and reschedule your appointment. You must reschedule your appointment if your child is unwell with any contagious illness. At Little Annie, we see a lot of newborn poppets and pregnant mums, and we don't want sickness to spread to these vulnerable people. Contagious illnesses such as chicken pox, conjunctivitis, whooping cough, or hand foot and mouth disease are unwelcome, so please add an additional five days following your doctor's recommendations before attending a shoot to ensure the safety of all children at Pop-ins, and to ensure your child is well enough to perform happily. We don't want to put our photographers in a position where they have to turn you away on health and safety grounds.

In the event of an epidemic or pandemic, Little Annie reserves the right to put in place additional precautionary measures - such as waiting for your session in your car, and bringing your own blanket for poppets under the age of four months. You will be notified of any additional precautions via email.

Can we reschedule?

Our rescheduling policy is under constant review to meet the changing needs of both our little clients and our team of self-employed photographers.

Your appointment is free to reschedule more than 7 days in advance.

You can change to a different available timeslot at the same event, at any time for free.

You can find the option to reschedule or change timeslot on your appointment info page.

Short notice reschedules made within 7 days of your event are subject to a $ 10 rescheduling fee, this fee contributes to the running cost of your original event as your timeslot is unlikely to be rebooked by another customer at short notice, and the administration required to process your rebooking. Please plan carefully when booking your appointment to avoid the need to reschedule due to a calendar clash. In exceptional circumstances, such as hospitalisation, this rescheduling fee may be waived, please contact your photographer to discuss your options.

Last minute reschedules are those which occur within 3 days of your booked event due to illness or accident. To arrange a last minute reschedule or to have your appointment credited please contact your photographer. You must make contact with your photographer before your event commences. Note that last minute reschedules or credits are only offered in valid circumstances. We appreciate you keeping unwell children away from our events where others with vulnerable needs such as immunocompromised or newborn babies may be present. Reschedule fees may also apply to last minute rescheduling at your photographer's discretion. Your email may take up to 3 working days to receive a response.

If you can not attend a make up session that is made available to you, you will forfeit your session fee.

Your appointment can be rescheduled a maximum of 31 days ahead, and can only be rescheduled once. For help with this, for example to reschedule a special event with non-recurring availability, please contact your photographer.

Please note that if you reschedule your appointment you will not be eligible for a refund should you choose to cancel your appointment in the future.

Cancelling

You can also opt to cancel your appointment for a 50% refund of the base appointment, any extras added are fully refunded. The option to cancel is available anytime that is ahead of your booked appointment, but cancellations made less than 24 hours ahead of your appointment will be non-refundable.

Appointments that have previously been rescheduled are ineliglble for a refund.

Photographer-directed changes

In the instance that your event can not go ahead due to photographer illness or lockdown, natural disaster or some other reason, your appointment will be rescheduled to a new date for free, or your appointment may be cancelled and credited with a coupon in the full value of your booking which can be used to rebook within 3 months of the date of cancellation.

Rescheduling to a different Photographer

Our Pop-in venues are owned and operated by independent licensees, some photographers operate multiple venues. When rescheduling your appointment to a different photographer's business you will be charged additional fees which cover the cost of the transaction. Your original appointment is cancelled and refunded within 10 working days, and a new session fee is charged to your saved card to rebook with your new photographer, the additional transaction fee is also included in this new billing. Note: your original session fee is refunded but this may take up to 10 working days to arrive back in your account.

When can we start Pop-ins?

Pregnant mums are welcome at our monthly Pop-in sessions to track the progress of their growing bump, however Little Annie Pop-ins are not recommended for not yet vaccinated babies under one month old due to the presence of other children at the event. It is recommended that you book a private newborn session at the photographer's studio during the first two weeks of your baby's life (POA). These sessions will allow the photographer enough time to get lots of gorgeous, settled shots of your baby and your family together. For more information on newborn and family portrait sessions please contact your photographer.

 

What if something goes wrong?

Refunds are not available on the occasion that you are not happy with your portrait, nor if your child/family is unable to attend the event due to illness. Your appointment can be easily rescheduled online ahead of your booking time, last minute fees may apply, see above.

 

Waitlists

Our waitlists are not a queue, when you join the waitlist for any event you will receive an email to notify you when a space becomes available at your chosen event. Other customers may be on the same mailing list and will be notified at the same time as you. You are not required to follow through with any eventual booking by joining the waitlist. You will not have any preferential claim to the available space. Another user, who may or may not be on the waitlist, may book the available space before you do. You will remain on the waitlist until you have booked an appointment, the event date has passed, or you remove yourself from the waitlist by visiting 'My Pop-ins' under your account.

 

Gift cards

By purchasing and/or redeeming a gift card, you agree to the following conditions:

To redeem your gift card, you have to have an account on popinphotos.com and you add the voucher code at the payment screen.

Bring a Friend Promotion

Little Annie may run a 'Bring a Friend' promotion where you receive a free close-up portrait if you bring a friend with you. Your friend must be new to Pop-ins to qualify.d. Your free close-up shot will be automatically added to your cart at checkout. One free close-up per poppet.

Free Bump Portrait Promotion

Free bump portraits are limited to one per pregnancy and can not be redeemed in conjunction with any other promotion or special offer. Bump portraits are available at Maternity Bump Pop-in events in all of our locations. To receive your bump portrait for free please complete the online form, you will receive a free bump booking within your online account and can book during the sign up process, or at a later date at an event near you. Free bump bookings are not transferable to born babies. If your child is born before you have the opportunity to redeem your free bump coupon, this is forfeited, existing appointments booked with your free bump code will be cancelled and you will need to rebook at full price to ensure you receive a Pop-in portrait of your baby.

Competitions and Giveaways

Sharing pages or a giveaway post, or tagging friends, is not a condition of entry of any competition.

The copyright of any images submitted still lies with Little Annie as per the user terms and conditions. However, you give Little Annie permission to use any quotes submitted on any post.

All competitions or giveaways are subject to Facebook policies.

Any giveaways are not endorsed, sponsored or administrated by Facebook/Instagram, nor is Facebook associated with any giveaway. By entering, you release Facebook from any responsibility to entrants or participants.

Photographer Exclusives

Photographer Exclusives are events that are created and operated by your photographer. Photographer Exclusives may include their own unique terms and conditions. Little Annie Ltd only provides the booking platform and technology for these events.

For the avoidance of doubt, you are conducting business directly with your photographer and any complaints or concerns can be directed to them via the contact form .

Little Annie Ltd shall only be liable to you for your use of our technology (this Pop-in website) and shall accept no further liability. If you want to find out more about what terms and conditions apply/do not apply to the specific Photographer Exclusive event, please contact your photographer.

Other Terms and Conditions

The intellectual property (including copyright) in all parts of the Pop-in™ session (including the set-up of the session, inner working of our web app, and the digital files) belong to Little Annie pursuant to the Copyright Act 1994 (NZ) and any local copyright laws in the country you are located. All such rights are reserved.

Pop-in is a registered trademark in New Zealand, Australia and Canada, and pending in the UK, USA, and the EU.

You are not permitted to use the copyright or the trademarks (except as permitted below) without the approval of Little Annie.

You shall have a non-exclusive licence to use the digital files in whatever way you see fit, limited to personal and non-commercial use, including disseminating the digital photos to third parties without further consent. For commercial use for the purposes of marketing or entry into online competitions, please seek express permission in writing via email. Our photographers really appreciate the opportunity to share their favourite photos in marketing to ensure the ongoing viability of Pop-ins as a high volume portrait opportunity. The images from Pop-in sessions may be released by you, for marketing locally both online and in print by your preferred photographer by toggling on the check box in your user account. If you adjust your sharing permission toggle to 'off' this will impact only future use of your images in marketing. To request the removal of images used in historical marketing please contact privacy@popinphotos.com. To release your images for our brandwide use online and in print around the world, by both Little Annie Monthly Pop-in Portraits and the Little Annie Printshop please complete the signed marketing waiver form

Please note that we only provide Pop-in sessions for domestic and private use. You agree not to use our site for any commercial or business purposes (see the above paragraph), and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity. Little Annie does not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees or contractors, and for fraud or fraudulent misrepresentation. Little Annie's liability arising out of Pop-in sessions is limited to direct losses only up to the price of your monthly Pop-in or the session you attended in the month of the loss.

Your appointment and use of this website is subject to the terms within our privacy policy. We will only use your personal information as set out in this policy.

Little Annie does not guarantee that this site, your account, or any content, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our site for business and operational reasons. You agree to release Little Annie from any liability for any claims whatsoever for consequential losses or in the event that written or digital materials or data are damaged, lost through computer or technology malfunction, hacking, lost in the mail, or are otherwise lost or damaged. We recommend that you keep a back-up of your monthly Pop-in photos in the event of a malfunction.

You are responsible for keeping your account details safe. Little Annie is not responsible for any unauthorised third party access, and we reserve the right to disable your account if, in our reasonable opinion, you have failed to comply with these terms and conditions.

The laws of New Zealand apply to these terms and conditions, Pop-in sessions, and any related subject matter. You and Little Annie agree that the courts of New Zealand will have exclusive jurisdiction over any dispute, however any judgement can be enforced in the country you are a resident in.

* References across our brand to gendered roles such as Mum and Dad refer to parents/grandparents/caregivers who identify as male, female or non-binary. Our intention is to create an inclusive space for all families. Regardless of where you fall in the gender identity spectrum, you are always welcome at Pop-ins.

If you do not agree to these terms, you must not use our site. We recommend you print a copy of these terms for future reference and we may update these terms from time to time to reflect changes to the Pop-in services, your needs, or our business priorities. We will endeavour to give you reasonable notice of any major changes.
